The owner of the Ship Hotel and Resort site had been seeking approval from the Western Australian Planning Commission (WAPC) to subdivide the site into 2 parcels, one comprising the Hotel and the other comprising a mixture of short stay and permanent residential accommodation.

Greg Rowe and Associates was contracted to assist with the project when the landowner received unfavourable comments from the Shire of Busselton and Tourism WA in relation to the Application and the matter was refered to the State Administrative Tribunal.

Greg Rowe and Associates, with the assistance of a specialist strata titles lawyer, successfully negotiated a land use and built form outcome for the site which ensured a financially suitable and workable solution for the landowner, yet met the requirements of both the Shire and Tourism WA. The solution negotiated by Greg Rowe and Associates was holistic in its approach and facilitated the creation of additional short-stay accommodation units without the loss of any residential units and avoided the need for a Full Hearing.

Town Planning

Having resolved the concerns of the Shire and Tourism WA, the Subdivision Application was approved by the WAPC.

While resolving the issues associated with the Subdivision Application, Greg Rowe and Associates also successfully co-ordinated several other approvals on the site, including a Development Application for a new three-storey building.

Greg Rowe and Associates also worked closely with the strata titles lawyer to develop a strata management plan for the resort which responded to the needs and requirements of the Shire and Tourism WA whilst being acceptable to the landowner.
